The Probationary Year at Denton Fire
30-second answer. Under Texas Local Government Code Section 143.027, a person appointed to a beginning position in a Chapter 143 fire department "must serve a probationary period of one year beginning on that person's date of employment as a fire fighter, police officer, or academy trainee." During that year the department head may discharge a probationer without the appeal rights a classified firefighter holds afterward. The six-month extension the statute allows some smaller cities does not reach Denton, because Denton has a meet and confer agreement.
The statute
Section 143.027(a), read live September 7, 2026: "A person appointed to a beginning position in the fire or police department must serve a probationary period of one year beginning on that person's date of employment as a fire fighter, police officer, or academy trainee."
The clock starts at employment, which for a Denton hire means the date the city puts you on the payroll, including any time spent in fire school after hire if you arrived as a licensed paramedic without fire certification.
The extension that does not apply
The same subsection lets a commission in a municipality under 1.9 million people extend probation by up to six months, but only for a person who "is not employed by a department in which a collective bargaining agreement or a meet-and-confer agreement currently exists or previously existed" and who is required to attend a basic certification academy. Denton's FY 2025-2026 Civil Service Fire Pay Plan refers to its meet and confer agreement on its face, so the first condition fails and the year stays a year.
What probation means in practice
Section 143.027(b) is the operative sentence for a new hire: during the probationary period the department head "shall discharge the person and remove the person from the payroll" if the person's appointment was not regular or was made in violation of the chapter, and may discharge for other cause without the hearing rights that attach once probation ends. Read plainly, the first year is the department's evaluation period and the statute gives it wide latitude.
Denton's own education record describes what fills that year for a new firefighter: annual training requirements of 20 hours of TCFP continuing education, NREMT recertification, and department training on special operations, on a three-platoon 24-hour-on, 48-hour-off schedule. A certified firefighter does not repeat fire school; a licensed paramedic hired without fire certification attends it after hire, inside the probationary clock.
After the year
Completion of probation is when Chapter 143's classified-service protections attach. The pay plan marks the same passage on the money side: Step B at two years, then C, D and E at three, four and five, and Step F at seven years.
