Ready to Serve Technologies LLC

1. Introduction and Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Ready to Serve Technologies LLC ("Company," "RTS," "we," "us," or "our") platform, including but not limited to the RTS-OS mobile application, the Grow Your Force recruiter dashboard, the Baseball Card candidate profile system, and any related services, content, and features (collectively, the "Service").
By accessing, installing, or using the Service in any form, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not use the Service.
The Service is operated by Ready to Serve Technologies LLC, a Texas limited liability company located at support@readytoserve.io.
2. Definitions
Account: Your user profile and associated credentials registered with the Service.
Baseball Card: Your candidate profile that displays your qualifications, fitness scores, credentials, career milestones, and other information compiled through the RTS-OS application.
Candidate: An individual user who registers with the Service to develop qualifications, track fitness readiness, manage credentials, and connect with recruiting agencies.
Content: Any information, text, data, graphics, audio, video, documents, or other material uploaded, submitted, or transmitted by you through the Service.
Grow Your Force: The recruiter-facing B2B subscription platform for recruiting agencies to browse, filter, and connect with verified candidates.
RTS-OS: The candidate-facing mobile application for fitness tracking, credential management, career pathway planning, and profile development.
Service: The Ready to Serve platform in all forms, including the RTS-OS mobile app, Grow Your Force recruiter dashboard, Baseball Card system, and any affiliated tools or features.
User: Any person who accesses the Service, whether as a Candidate, recruiter, agency representative, or other user type.
3. Account Registration
3.1 Eligibility
To register an Account with the Service, you must be at least 18 years old and a legal resident of the United States. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction.
3.2 Accurate Information
You agree to provide accurate, current, and complete information when registering an Account. You are responsible for maintaining the accuracy of your account information and for updating it as necessary. You agree not to provide false, misleading, or fraudulent information.
3.3 Account Security
You are responsible for all activity on your Account, including any activity initiated by someone else with your credentials. You agree to keep your password and login credentials secure and confidential. You will not share your Account credentials with any other person or allow anyone else to access your Account.
You must immediately notify us of any unauthorized access to your Account or any other breach of security by emailing support@readytoserve.io.
3.4 One Account Per Person
You agree to maintain only one active Account per person. Creating multiple accounts to circumvent usage limits, deceive other users, evade suspensions, or manipulate the Service is prohibited. We reserve the right to merge or suspend duplicate accounts.
3.5 Account Termination
You may delete your Account at any time through your account settings or by contacting support@readytoserve.io. Upon deletion, your Account and associated data will be deactivated according to our data retention policies. Some data may be retained as required by law or for legitimate business purposes.
4. Subscriptions and Payments
4.1 Subscription Tiers
The Service offers multiple tiers of access:
Candidates: Candidate access to RTS-OS and Baseball Card development is available at no cost for essential features. Optional premium features may require payment.
Recruiting Agencies: Access to Grow Your Force is available through three subscription tiers: Starter ($200/month), Professional ($750/month), and Enterprise (custom pricing). Prices are in USD and subject to change with 30 days' notice.
4.2 Stripe Payment Processing
All payments are processed through Stripe, a third-party payment processor. By submitting payment information, you authorize us to charge your selected payment method. You agree to provide accurate and current payment information and to keep it updated.
We do not store full credit card numbers. Payment processing is handled by Stripe in compliance with PCI DSS standards. You agree to Stripe's terms of service, available at stripe.com/legal.
4.3 Billing and Invoicing
Subscriptions are billed according to the selected plan cycle (monthly or annual). Billing occurs on the same day each month or year, depending on your plan. Invoices are sent to the email address associated with your Account.
4.4 Auto-Renewal
Paid subscriptions will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge the payment method on file for each renewal cycle.
15-Day Renewal Reminder (California Compliance):
At least 15 days before any automatic renewal, we will send you an email reminder that includes:
- The renewal date
- The amount that will be charged
- A clear link or instructions to cancel your subscription without penalty
- Your cancellation options (see Section 4.5 below)
Explicit Cancellation Methods:
You may cancel your subscription at any time using one or more of the following methods, all of which are effective immediately upon confirmation:
1. Online: Cancel directly through your Account settings on the Service
2. Email: Send a cancellation request to support@readytoserve.io with your Account email address
3. Phone: Contact us at the phone number provided in our Contact Information (Section 20)
Cancellation is effective immediately upon confirmation. You will receive a confirmation email verifying cancellation. No further charges will be made after the cancellation date, except those already incurred.
No Automatic Consent to Renewal:
Your initial purchase does not constitute automatic consent to all future renewals. Your continued use of the Service following the renewal reminder email does not constitute consent to renewal. To renew, you must affirmatively authorize each renewal or allow the automatic renewal to proceed without affirmative action.
4.5 Cancellation
You may cancel your subscription at any time through your Account settings or by contacting support@readytoserve.io. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months or unused portions of a billing cycle, except as required by law.
4.6 Failed Payments
If a payment fails, we will attempt to process it again. If payment continues to fail after multiple attempts, we may suspend your Account until payment is received. You are responsible for any fees incurred as a result of failed payments.
4.7 Refunds and Disputes
Refund requests must be submitted in writing to support@readytoserve.io within 30 days of the charge. Refunds are issued at our discretion and only in cases of clear billing error or service failure.
5. User Content and Baseball Card
5.1 Ownership of Content
You retain ownership of all Content you upload or submit to the Service, including your Baseball Card profile, credentials, fitness data, photos, and any other materials.
5.2 License to RTS
By uploading Content to the Service, you grant Ready to Serve Technologies LLC a non-exclusive, royalty-free, worldwide license to use, display, store, reproduce, and transmit your Content for the purpose of operating the Service and presenting your Baseball Card to connected recruiting agencies and other authorized users.
You understand that your Baseball Card and associated information may be viewed by recruiters, agencies, and other users as permitted by your privacy settings and the platform's functionality.
5.3 Third-Party Access
By using the Service, you consent to your Baseball Card profile, credentials, and qualification information being displayed to recruiting agencies and recruiters who have legitimate access to the Grow Your Force platform. You may control certain privacy settings related to your profile visibility.
5.4 Accuracy Responsibility
You are responsible for the accuracy, completeness, and legality of all Content you submit. You represent and warrant that:
- All information in your Baseball Card is true, accurate, and current.
- All credentials listed are genuine and have not been falsified or misrepresented.
- All fitness scores and assessment results are accurately reported.
- You have the right to upload and share all Content you submit.
- Your Content does not infringe on the intellectual property or privacy rights of any third party.
5.5 Content Removal
We reserve the right to remove any Content that violates these Terms or applicable law. You agree to remove any Content that we identify as inaccurate, misleading, or in violation of these Terms within a reasonable timeframe. Failure to do so may result in Account suspension or termination.
6. Acceptable Use
You agree not to engage in any of the following prohibited activities while using the Service:
6.1 Credential Misrepresentation
You will not upload, list, or claim any credentials, certifications, or qualifications you do not actually possess. This includes falsifying military service records, firefighting certifications, emergency medical certifications, or any other professional credential.
6.2 False Information
You will not provide false, misleading, or fraudulent information on your profile, including but not limited to:
- Fake name or identity
- Falsified military service or discharge status
- Unearned fitness scores or assessment results
- Manufactured educational credentials
- Fabricated work history
6.3 Data Scraping and Automated Access
You will not scrape, crawl, mirror, or automated extract candidate data, recruiter lists, or any other information from the Service. You will not use bots, spiders, or other automated means to access or monitor the Service without express written permission.
6.4 Credential Sharing
You will not share your Account credentials, username, password, or API keys with any other person. You are solely responsible for all activity on your Account.
6.5 Unauthorized Access
You will not attempt to gain unauthorized access to the Service, other user accounts, or restricted areas of the platform.
6.6 Interference with Service
You will not interfere with the operation of the Service, including attempts to:
- Overload servers with requests
- Bypass security measures or access controls
- Inject malicious code
- Disrupt normal functioning of the platform
6.7 Illegal Content
You will not upload, transmit, or display any content that is illegal, obscene, defamatory, harassing, abusive, or violates the rights of any third party.
6.8 Impersonation
You will not impersonate any person or organization, misrepresent your affiliation with any person or organization, or make false claims about your qualifications or status.
6.9 Harassment and Abuse
You will not use the Service to harass, threaten, intimidate, or abuse any person. This includes unsolicited contact, repeated unwanted messages, or discriminatory behavior.
7. Fitness and Health Data Disclaimer
7.1 Not Medical Advice
The RTS-OS fitness tracking features, workout programming, and fitness assessment tools are provided for informational purposes only. They do not constitute medical advice, professional medical diagnosis, or treatment recommendations.
7.2 Physician Consultation
Before beginning any fitness program or exercise routine provided through the Service, you agree to consult with a licensed physician or healthcare provider. This is especially important if you have any pre-existing medical conditions, injuries, or health concerns.
7.3 No Warranty
Ready to Serve Technologies LLC makes no warranty regarding the accuracy, completeness, or safety of fitness programming or health data provided through the Service. We are not responsible for any injury, illness, or adverse outcome resulting from your use of fitness features or your participation in any exercise program.
7.4 Assumption of Risk
You assume all risk associated with the fitness activities you perform based on information or programming obtained through the Service. You are responsible for determining whether any fitness activity is appropriate for your individual health status and physical condition.
8. Credential Verification
8.1 RTS Facilitates Display Only
Ready to Serve Technologies LLC facilitates the display of credentials on your Baseball Card but does not independently verify the authenticity of credentials you upload. The presence of a credential on your profile does not guarantee its accuracy or validity. RTS makes no representation regarding credential verification and conducts no background checks or credential authentication.
8.2 Agency Responsibility for Independent Verification
Recruiting agencies and employers using the Service are solely responsible for independently verifying all credentials, qualifications, certifications, military service records, fitness assessments, and all other information provided by candidates through official channels before making any hiring decisions. This includes:
- Contacting the issuing credentialing body directly
- Verifying military service through official military records
- Confirming certifications through licensing boards or professional organizations
- Conducting background checks through authorized third-party providers
- Verifying employment history with prior employers
- Confirming educational credentials with institutions
We do not represent or guarantee the accuracy of any credentials displayed on the platform.
8.3 No Liability for Credential Errors
Ready to Serve Technologies LLC is not liable for any errors, omissions, or inaccuracies in credentials you upload, nor are we liable for any damages or losses resulting from an agency's reliance on inaccurate credential information or failure to independently verify credentials.
8.4 Credential Authenticity and Legal Warnings
You represent and warrant that all credentials you upload are authentic, current, and issued by the legitimate credentialing body.
IMPORTANT LEGAL WARNINGS:
Falsifying Credentials as Fraud: Falsifying, misrepresenting, or fraudulently claiming credentials you do not possess may constitute criminal fraud under Texas Penal Code § 37.10 and applicable federal and state fraud statutes. This may result in criminal prosecution, restitution, and imprisonment.
Military Records Fraud (Federal Crime): Falsifying, forging, or misrepresenting military service records, discharge status, or military credentials is a federal crime under 18 U.S.C. § 1001 (False statements and fraud) and 18 U.S.C. § 922(a)(6) (if related to firearm eligibility). This may result in federal prosecution, fines up to $250,000, and imprisonment up to 10 years.
Agency Verification Requirement: Recruiting agencies must independently verify all military records, certifications, and credentials through official government and institutional channels. RTS does not conduct this verification. Misrepresentation of credentials is grounds for immediate Account suspension and termination by RTS, and may trigger civil and criminal liability.
8.5 RTS Does Not Conduct Credential Verification
Ready to Serve Technologies LLC explicitly does not:
- Verify the authenticity of any credential, certification, or qualification
- Conduct background checks
- Verify military service records
- Confirm educational credentials
- Authenticate professional licenses or certifications
- Represent that any credential displayed is genuine
Recruiting agencies and employers must conduct all verification independently.
9. Intellectual Property
9.1 RTS Ownership
Ready to Serve Technologies LLC owns all intellectual property rights in the Service, including the RTS-OS platform, Grow Your Force recruiter dashboard, Baseball Card system, website, software, content, design, graphics, logos, trademarks, and any other materials created or compiled by us.
Your use of the Service grants you a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms. You may not copy, modify, distribute, sell, or exploit any part of the Service without express written permission.
9.2 User Content Rights
By submitting Content to the Service, you grant Ready to Serve Technologies LLC a non-exclusive, royalty-free, worldwide, perpetual license to use, display, distribute, and create derivative works from your Content for the purpose of operating and improving the Service.
You retain ownership of your Content and may request deletion of your Account and associated data, subject to our data retention policies.
9.3 Trademark Usage
The Ready to Serve trademark and brand name are owned by Ready to Serve Technologies LLC. You may not use our trademarks without express written permission. Use of any Ready to Serve branding or logos is strictly prohibited without authorization.
10. Privacy
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at readytoserve.io to understand our data collection, use, storage, and sharing practices.
By using the Service, you consent to the collection and use of information as described in our Privacy Policy.
11. Disclaimers
11.1 "As Is" Service
The Service is provided on an "as is" and "as available" basis without any representations, warranties, or conditions of any kind, whether expressed or implied. Ready to Serve Technologies LLC does not warrant that the Service will be error-free, uninterrupted, or meet your specific requirements.
11.2 Employment Disclaimer and RTS Non-Role
RTS Does NOT Act as Recruiter, Headhunter, or Employment Agency:
Ready to Serve Technologies LLC does not act as a recruiter, headhunter, employment agency, or labor contractor. RTS is a technology platform operator only.
RTS Makes No Endorsements or Pre-Screening:
- RTS does not endorse, recommend, validate, or pre-screen any candidate
- RTS does not represent candidate qualifications to agencies
- RTS does not conduct background checks or credential verification
- RTS has no role in hiring decisions, candidate selection, or agency staffing decisions
- RTS does not guarantee employment, job placement, or contact from any recruiting agency
The Service Facilitates Connection Only:
The Service is a platform that facilitates connection between candidates and recruiting agencies. Whether any given candidate is contacted, interviewed, or hired is entirely at the sole discretion of recruiting agencies and employers. RTS makes no representations regarding any agency's hiring process, timeline, or decisions.
Employment at Will:
If a candidate is hired through a connection made on the Service, employment with the recruiting agency or employer is at-will, subject to the hiring entity's policies and applicable law. RTS has no role in employment relationships and is not liable for any employment-related disputes, discrimination, wrongful termination, or other employment claims.
Background Check Cooperation:
Candidates agree to cooperate fully with any background checks, credential verification, or investigations conducted by recruiting agencies or employers. Failure to cooperate or providing false information during these processes is grounds for rejection or termination by the hiring entity and may violate these Terms.
RTS Not Liable:
Ready to Serve Technologies LLC is not liable for:
- Any hiring or non-hiring decisions by recruiting agencies or employers
- Any rejections, discrimination, or adverse employment actions
- Any disputes between candidates and hiring entities
- Any failures of agencies to conduct proper verification or background checks
- Any consequences of hiring ineligible or unqualified candidates
- Any civil rights violations, employment law violations, or discrimination claims
11.3 No Guarantee of Recruitment
Use of the Service does not guarantee that recruiting agencies will view your profile, contact you, or consider you for positions. Agencies have sole discretion over whether and how to interact with candidates on the platform.
11.4 Agency Independence
Recruiting agencies and employers using the Service are independent contractors. Ready to Serve Technologies LLC does not control their hiring decisions, communications, or conduct. We are not responsible for any actions or omissions of agencies using the platform.
11.5 No Legal Advice
The Service does not provide legal advice. Career guidance and information provided through the Service are for informational purposes only. If you require legal advice regarding military service, veterans benefits, government employment, or any other matter, consult a qualified attorney.
11.6 Third-Party Links
The Service may contain links to third-party websites and resources. We are not responsible for the content, accuracy, or privacy practices of any third-party sites. Your use of third-party sites is governed by their own terms and policies.
12. Limitation of Liability
12.1 Cap on Damages
Except as prohibited by law and except as provided in Section 12.2 below, Ready to Serve Technologies LLC's total liability to you for any and all claims arising out of or related to the Service shall not exceed the total amount you paid to us for access to the Service in the 12 months preceding the claim.
If you have not paid any fees to us, our liability is limited to $100.
12.2 Carve-Outs from Liability Cap
The liability cap in Section 12.1 does NOT apply to:
1. Gross Negligence or Willful Misconduct: Any claim arising from our gross negligence, recklessness, or willful misconduct
2. Breach of Confidentiality: Violations of our obligations to maintain confidentiality of your personal information or sensitive data
3. Intellectual Property Infringement: Our infringement of your intellectual property rights or third-party infringement claims related to our operation of the Service
4. Indemnification Obligations: RTS's indemnification obligations to you under Section 13 of these Terms
5. Fraud: Any claim arising from fraudulent misrepresentation or fraud by RTS
6. Non-Waivable Liability: Any liability that cannot be limited or excluded by applicable law, including statutory violations that are non-waivable
These carve-outs are not subject to any cap and may result in liability exceeding the amounts specified in Section 12.1.
12.3 Excluded Damages
Ready to Serve Technologies LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or loss of use, even if we have been advised of the possibility of such damages.
This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort, strict liability, or otherwise.
Exception: This exclusion does not apply to the carve-outs listed in Section 12.2, where full damages (including consequential damages) may apply.
12.4 Essential Term
You acknowledge that these liability limitations are an essential term of these Terms and are necessary to keep the Service affordable and available. Without these limitations, we would be unable to offer the Service.
13. Indemnification
You agree to indemnify and hold harmless Ready to Serve Technologies LLC and its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your breach of these Terms
- Your violation of any applicable law
- Your Content or information you submit to the Service
- Your infringement of any intellectual property or privacy rights of third parties
- Any injury, illness, or damages arising from fitness activities or health information obtained through the Service
- Any misrepresentation or falsification of credentials or qualifications on your profile
You agree to defend us against any such claims and to cooperate fully in our defense.
13.1 RTS Indemnification to Candidates
Ready to Serve Technologies LLC agrees to indemnify and hold harmless you from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Any breach by RTS of these Terms or any applicable law
- Any gross negligence or willful misconduct by RTS
- Any infringement by RTS of your intellectual property rights
- Any unauthorized disclosure or misuse of your personal information by RTS
- Any failure by RTS to protect your data or maintain confidentiality
RTS will defend you against such claims and cooperate fully in your defense.
13.2 Carve-Out from Confidentiality Obligations
Nothing in these Terms, any confidentiality agreement, or any non-disparagement provision shall prohibit you from:
1. Reporting Fraud or Abuse: Reporting any actual or suspected fraud, abuse, illegal activity, or misconduct to law enforcement agencies, regulatory agencies, or government entities
2. Regulatory Disclosure: Providing truthful information or testimony to the U.S. Securities and Exchange Commission (SEC), Federal Trade Commission (FTC), U.S. Department of Justice (DOJ), state attorneys general, or other government agencies
3. Government Cooperation: Cooperating with, participating in, or providing truthful testimony to investigations or proceedings conducted by any government agency or legislative body
4. Legal Requirement: Disclosing information as required or permitted by law, court order, subpoena, or regulatory requirement
5. Attorney Consultation: Consulting with a lawyer regarding your legal rights or obligations under these Terms
6. Internal Complaint: Filing a complaint with an internal ethics hotline, compliance department, or similar mechanism
You do not need to notify RTS before making any such reports or disclosures. No provision of these Terms limits your ability to participate in investigations or cooperate with government agencies.
14. Termination
14.1 Termination by RTS
#### Immediate Termination (No Cure Period)
Ready to Serve Technologies LLC may terminate or suspend your Account and access to the Service immediately, without notice or opportunity to cure, if you:
- Provide false, fraudulent, or misleading information (especially regarding credentials, military service, or qualifications)
- Misrepresent or falsify credentials or qualifications
- Engage in fraud or intentional deception
- Attempt unauthorized access or interfere with the Service
- Engage in harassment, abuse, threats, or conduct harmful to other users
- Violate any applicable law or engage in illegal activity
- Pose a serious risk to the security or integrity of the Service
#### Termination with Cure Period (Other Breaches)
For violations of these Terms that do not involve fraud, credential falsification, or illegal activity, RTS will provide you with:
1. Written Notice: Clear, detailed notice of the specific provision(s) you have violated
2. 15-Day Cure Period: A 15-day period during which you may cure the violation and remain in good standing
3. Opportunity to Respond: The opportunity to explain your conduct and remedy the issue
4. Good Faith Effort: Reasonable notice that allows you to take corrective action
Examples of violations subject to the cure period include: violation of acceptable use policies (if not fraud), data accuracy issues (if not fraudulent), or other non-fraud breaches.
If the violation is not cured within 15 days, RTS may proceed with termination.
14.2 Termination by User
You may terminate your Account at any time by deleting it through your account settings or by contacting support@readytoserve.io.
14.3 Effect of Termination
Upon termination, your right to use the Service immediately ceases. You remain liable for any outstanding fees, charges, or obligations incurred before termination. We may retain your information as required by law or for legitimate business purposes.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflicts of law principles. You agree that Texas law governs the interpretation of these Terms, the rights and obligations of the parties, and all claims and disputes, regardless of conflicts of law principles or your location.
16. Dispute Resolution
16.1 Informal Resolution
Before initiating formal proceedings, you agree to attempt to resolve any dispute with Ready to Serve Technologies LLC through informal negotiation. Send written notice of the dispute to support@readytoserve.io with a detailed description of the issue and your proposed resolution. We will respond within 30 days.
16.2 Binding Arbitration
If the dispute cannot be resolved through informal negotiation within 60 days, you agree that any and all disputes, claims, or controversies arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services) in accordance with its Comprehensive Arbitration Rules and Procedures.
The arbitration shall take place in Dallas, Texas, or another location mutually agreed upon by the parties. The arbitrator shall be a single neutral arbitrator with experience in technology and contract disputes. Each party shall bear its own attorneys' fees and costs, and the parties shall equally split the arbitrator's fees and administrative costs.
16.3 Small Claims Exception
Notwithstanding the arbitration clause, you may pursue claims in small claims court in Dallas, Texas, or your home state if the claim qualifies for small claims jurisdiction.
16.4 No Class Actions
You agree that any arbitration or legal proceeding shall be conducted on an individual basis, not as a class action, class arbitration, or any other proceeding involving multiple parties. You waive your right to participate in class actions or class arbitrations against Ready to Serve Technologies LLC.
16.5 Jury Trial Waiver
You waive your right to a jury trial. Any dispute will be resolved by arbitration before a neutral arbitrator rather than by a jury.
17. Changes to Terms
Ready to Serve Technologies LLC reserves the right to modify these Terms at any time. Changes become effective upon posting the revised Terms to readytoserve.io. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes.
We will provide notice of material changes via email at least 30 days before the changes take effect. If you do not agree to the revised Terms, you must discontinue use of the Service.
Material Adverse Changes:
For material adverse changes to these Terms (i.e., changes that significantly harm users or restrict their rights), you may decline the revised Terms by terminating your Account without penalty within 30 days of receiving notice. Your subscription will not renew, and you will not be charged further fees.
17.1 Changes to Terms for Active-Duty Servicemembers
Servicemembers Civil Relief Act (SCRA) Override:
To the extent any provision of these Terms conflicts with the rights of active-duty servicemembers under the Servicemembers Civil Relief Act (50 U.S.C. § 3701 et seq.), the SCRA prevails, and RTS will comply with SCRA requirements, including:
1. Extension of Time: RTS will grant reasonable extensions of time for any obligations under these Terms when military service materially affects your ability to comply
2. Stay of Proceedings: RTS will not enforce any provision that would violate your rights to a stay of proceedings under the SCRA
3. Right to Terminate: If you are called to active duty, you may terminate your subscription without penalty with 30 days' notice and proof of military orders requiring active duty. You will not be charged for any period following the effective date of termination.
If you are an active-duty servicemember and believe your SCRA rights have been violated, contact support@readytoserve.io with proof of active-duty status.
18. Severability and Waiver
18.1 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed from these Terms. The remaining provisions shall remain in full force and effect.
18.2 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future. No waiver is effective unless in writing and signed by an authorized representative of Ready to Serve Technologies LLC.
19. Entire Agreement
These Terms, together with our Privacy Policy and any other documents or policies referenced herein, constitute the entire agreement between you and Ready to Serve Technologies LLC regarding the Service. These Terms supersede any prior agreements, understandings, and negotiations, whether written or oral, related to the Service.
20. Scam and Phishing Warning
20.1 Scam Prevention
Candidates should be aware that job scams and phishing attempts are common in the recruiting industry. Ready to Serve Technologies LLC will never:
- Ask for your password, login credentials, or two-factor authentication codes
- Request payment, deposits, or upfront fees before a formal job offer
- Ask for your Social Security number, bank account details, or credit card information before formal employment
- Request Western Union, wire transfers, gift cards, or cryptocurrency payments
- Pressure you to act quickly without proper vetting and verification
- Ask you to work on projects or assignments before a signed offer letter
- Claim you have "won" a job or been selected without an interview process
20.2 Identifying Scams
Be cautious of:
- Emails from addresses that don't match official RTS or recruiter domains
- Unsolicited requests for personal information via email, text, or social media
- Job postings that offer unusually high pay for minimal qualifications
- Requests to conduct transactions outside the platform or RTS system
- Grammar, spelling, or formatting errors in official communications
20.3 Report Suspicious Activity
If you receive a communication that appears to be a scam or phishing attempt claiming to be from RTS or a recruiting agency, do not respond or provide any information. Report it to support@readytoserve.io with as much detail as possible.
21. Additional Provisions
21.1 No Agency
Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Ready to Serve Technologies LLC.
21.2 Force Majeure
Ready to Serve Technologies LLC shall not be liable for any failure to perform its obligations under these Terms if such failure is due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government action, or pandemic.
21.3 Survival
The provisions of these Terms that by their nature are intended to survive termination shall survive, including but not limited to limitations of liability, indemnification, intellectual property rights, and dispute resolution.
